Membership Agreement

1. www.e-kom.com website, which carries out the activities of BEYLİKDÜZÜ OSB MAH. HÜRRİYET BULVARI ASF-BATI PLAZA NO:10/9 BEYLİKDÜZÜ-34524/ISTANBUL located at the address EKOM ELEKTRİK ELECTRONİK SANAYİ VE TİCARET A.Ş. Hereinafter referred to as "EKOM" .
2. The internet user who is a member of the website www.e-kom.com ("Website") will hereinafter be referred to as the "Member".

The subject of this Agreement is to determine the terms and conditions of the member's use of the website www.e-kom.com owned by EKOM.

1. The Member declares and undertakes that the personal and other information he/she provides while becoming a member of the website www.e-kom.com is correct in accordance with the law, that he/she has reached the age of 18 and has the legal capacity to enter into this aggrement, and that he/she shall fully and immediately compensate all damages that EKOM may incur due to the untruthfulness of this information. The Member accepts, declares and undertakes that all kinds of information and content transmitted while becoming a member of the Website are correct and lawful. EKOM, EKOM employees and executives have no obligation and responsibility to investigate, examine and undertake the accuracy and legality of the information and content transmitted and/or modified by the Members, and are not responsible for any damages that may arise due to the incorrectness/inaccuracy of this information. The Member accepts and declares that all information provided during the membership process, including information such as name, surname, contact information and payment information, is correct and complete. In case of violation of this article by the Member, the Member is obliged to pay all direct and indirect damages incurred by EKOM in cash and in the first demand. Although EKOM is not responsible for the content shared by the Member, EKOM has the right to review the content shared by the Member and remove it from the Website without giving any reason, provided that it is entirely on its own initiative.
2. The member cannot give the password created by the member to other persons or organizations, the right to use the password belongs to the member himself/herself. Against all liability that may arise for this reason and all claims and demands that may be asserted against EKOM by third parties or competent authorities, EKOM reserves the right to all kinds of compensation and other claims arising from such unauthorized use. The use, storage, protection and security of all system access tools, including membership information, password and personal information used by the Member in order to benefit from the Website services, are solely the Member's responsibility. EKOM shall not be liable for any damages suffered and/or incurred by the Member and/or third parties due to access and/or use of the system access tools by third parties, transfer, theft, loss and/or change of hands of the devices used by the members.
3. The member accepts and undertakes from the beginning to comply with the provisions of the current legal legislation and not to violate them while using the website www.e-kom.com. Otherwise, all legal and criminal liabilities that may arise shall be fully and exclusively binding on the member.
4. The member shall not use the www.e-kom.com website in any way that disrupts public order, violates public morality, disturbs and harasses others, for an illegal purpose, or infringes the intellectual and copyright rights of others. In addition, the member may not engage in activities (spam, virus, trojan horse, etc.) and transactions that prevent or make it difficult for others to use the services. The Member agrees to ensure that all content, including comments, communications and questions provided on the Site, comply with the law and morality. (i) That the contents do not violate the privacy of third parties, do not violate their personal rights, do not contain personal information of third parties, (ii) That the contents do not contain any information that may lead to suicide, sexual abuse of children, facilitation of the use of drugs or stimulants, supply of dangerous substances for health, obscenity, prostitution, not constitute elements of acts considered as crimes in the legislation of the Republic of Turkey, including the crimes of providing a place and opportunity for gambling and the crimes in the Law on Crimes Committed Against Atatürk, not contain political propaganda, (iii) not contain viruses, trojan horses, spam and other harmful, disruptive or destructive files, including but not limited to. EKOM shall have the right to refuse to publish the contents on the WEBSITE in case the contents are in violation of this article. In the event that the Member violates its obligations arising from this article, the Member shall be liable for all direct and indirect damages of EKOM.
5. The ideas and opinions expressed, written and used by the members on the www.e-kom.com website are entirely the personal opinions of the members and are binding on the opinion holder. These views and opinions have no relation and connection with EKOM. EKOM shall not be liable for any damages that may be incurred by third parties due to the ideas and opinions expressed by the member and for any damages that may be incurred by the member due to the ideas and opinions expressed by third parties.
6. EKOM shall not be liable for any unauthorized reading of member data and any damage to member software and data. The Member agrees in advance not to claim compensation from EKOM for any damages that may be incurred due to the use of the website www.e-kom.com. The Member is obliged to use the WEBSITE in accordance with the law and not to damage the WEBSITE in any way. The Parties agree that this Agreement may be terminated immediately by EKOM in the event that the Member maliciously disrupts the operation and functionality of the INTERNET SITE by using DDOS, trojan horses, viruses and similar methods, prevents access to the INTERNET SITE, corrupts and/or destroys, modifies, makes inaccessible and/or adds data to the INTERNET SITE in violation of the law. In this case, the Member is obliged to pay all direct and indirect damages incurred by EKOM in cash and lump sum at the first demand.
7. The member agrees not to access or use the software and data of other internet users without authorization. Otherwise, the legal and criminal liabilities arising from this belong entirely to the member.
8. The member who violates one or more of the articles listed in this Membership Agreement is personally criminally and legally responsible for the violation and will keep EKOM free from the legal and criminal consequences of these violations. In addition; Due to the violation, if the incident is transferred to the legal field, EKOM reserves the right to claim compensation against the member for non-compliance with the membership agreement.
9. EKOM always has the right to unilaterally delete the membership of the member, delete the files, documents and information belonging to the customer. The member accepts this saving in advance. In this case, EKOM has no responsibility.
10. www.e-kom.com website software, design and all content and documents such as logos, pictures, products, information, documents, etc. on the website are the property of EKOM, and copyright and/or other intellectual property rights related to them are protected by relevant laws and international conventions, and they cannot be used, acquired, copied and modified by the member without permission. Within the scope of the Law on Intellectual and Artistic Works and the relevant legislation, the Member accepts, declares and undertakes that he/she is responsible for all criminal, legal and administrative consequences within the scope of the Law on Intellectual and Artistic Works in the event that he/she reproduces, copies, processes and in similar cases reproduces, copies, processes the INTERNET SITE and the built system of the INTERNET SITE in whole or in part without the prior permission of EKOM. Other domestic/foreign companies and products mentioned on this website are trademarks of their owners and are also protected under intellectual property rights.
11. EKOM may collect certain information such as the name and Internet Protocol (IP) address of the Internet service provider used to access the website, the date and time of access to the website, the pages accessed while on the website and the Internet Address of the Website that allows direct connection to the website, in order to improve and develop the www.e-kom.com website and/or within the framework of legal legislation. The Member accepts and declares that all of the personal information they have defined on the Website (product, member, traffic information, message records, IP information, etc.) will be stored by EKOM in accordance with the provisions of the Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through These Publications.The Member accepts and declares that EKOM is authorized to disclose confidential/commercial/private information belonging to him/her to the official authorities and/or right holders in the event that the rights of other members and/or third parties are allegedly violated in accordance with the provisions of the legislation in force and the regulations in the DISCLOSURE TEXT. For this reason, the Member accepts, declares and undertakes that no compensation can be claimed from EKOM under any name.
12. EKOM may use the personal information of the members in order to provide better service to the users of the EKOM website, to improve its products and services, to facilitate the use of the site, and to work on the special preferences and interests of its users. EKOM reserves the right to keep a record of the member's activities on the www.e-kom.com website.
13. The user who is a member of EKOM declares and accepts that he/she allows EKOM to offer him/her product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction applications within the scope of the applications in force and/or to be put into force. The Member declares and agrees that he/she allows his/her personal and shopping information and shopping and/or consumer behavior information that he/she has provided in the past and/or will provide in the future while becoming a member of EKOM and/or by other means to be collected, shared, used and archived by EKOM for the above purposes. Unless the Member declares otherwise, the Member declares and accepts that he/she allows the data to be collected, shared, used and archived by EKOM when his/her membership expires. The Member declares and accepts that he/she allows EKOM to contact him/her via internet, telephone, SMS, etc. communication channels unless otherwise notified. The Member declares and agrees that he/she will not make any claim and will not hold EKOM responsible for any direct and / or indirect material and / or indirect material and / or moral negative and / or positive damages due to the collection, sharing, use, archiving and access to the above-mentioned information. The Member can access detailed information about his/her personal data from the Customer Clarification Text page.
14. EKOM may disclose a member's personal information when required to do so by law or in the good faith belief that such disclosure is necessary to (a) comply with legal requirements or legal process served on EKOM; (b) protect and defend the rights and property of EKOM and the EKOM website family.
15. Measures have been taken to ensure that the EKOM website is free of viruses and similar software. In addition, in order to ensure ultimate security, the user must supply his/her own virus protection system and provide the necessary protection. In this context, by accessing the EKOM website, the member accepts that he/she is responsible for all errors that may occur in his/her software/hardware and operating systems and their direct or indirect consequences.
16. EKOM reserves the right to change the content of the website at any time, to change or terminate any service provided to users or to delete user information and data stored on the EKOM website.
17. EKOM may change, update or cancel the terms and conditions of the membership agreement at any time without the need for prior notice and warning in any form or manner. Any amended, updated or repealed provision shall be effective for all members on the date of publication.
18. The parties acknowledge and agree that all computer records belonging to EKOM shall be taken as the sole and true exclusive evidence in accordance with Article 189 of the Code of Civil Procedure and that such records constitute an evidential contract.
19. In accordance with the membership agreement, EKOM has the authority to send informative e-mails to the e-mail addresses of its members registered with it and informative SMS to their mobile phones, and by approving this Membership Agreement, the Member will be deemed to have accepted the sending of informative e-mails to the e-mail address and informative SMS to the mobile phone. In case the Member wishes to opt out of receiving e-mails and/or SMS, he/she will be able to cancel the mail and SMS sending in the "Profile Details" section.

This Agreement will remain in force until the member cancels his/her membership or his/her membership is canceled by EKOM. EKOM may unilaterally terminate the agreement by canceling the membership of the member if the member violates any provision of the membership agreement.

The failure of a Party to exercise or delay in exercising a right arising out of this Agreement, or the failure of the other Party to exercise or delay in exercising the rights granted to it despite its breach of the provisions of this Agreement or legislation, shall not be construed as a partial or complete waiver of such rights.

Küçükçekmece Courts and Küçükçekmece Enforcement Offices are authorized for disputes regarding this Agreement.

Membership registration means that the member has read all the articles in the Membership Agreement and accepts the articles in the membership agreement. This Agreement was concluded at the time the member became a member and entered into force mutually.
